We Know What It Takes to Secure a Modification

For a modification to be granted, the court must be presented with evidence of what they call a material change in circumstances or in the case of child support, a significant variance. What counts as a material change depends to a degree on the views of the judge hearing your petition to modify. A modification of child support requires a 15 percent increase or decrease in what you would pay or receive to merit the court's intervention.

The court encourages parents to work out an agreement on the issue at hand. When agreement cannot be reached between the parties, the court will require that you enter mediation to attempt to bridge the differences that are preventing an agreement from being reached. If mediation cannot produce an agreement, the Court would make the ultimate decision on whether a change is warranted under the circumstances.
